Child Custody Standards for Poquoson Cases
Custody decisions follow the best interests of the child standard under § 20-124.2 and § 20-124.3. Virginia does not favor either parent by default. The court looks only at the child's welfare.
Factors the court weighs include the child's age and condition, each parent's physical and mental condition, the existing bond between each parent and the child, the child's need for consistent relationships with siblings and extended family, each parent's past role in caregiving, and each parent's willingness to support the other's relationship with the child. A history of family abuse or sexual abuse is a significant factor. The child's preference is considered if the child is mature enough to form a reasonable view.
Under § 20-124.4, parents in disputed custody cases must attend a dispute resolution orientation before a trial. Mediation is an option that many families use to reach agreements without a full hearing. Section 20-124.5 requires 30 days written notice before a parent relocates with the child. A planned move can trigger a review of the existing custody order.
