Portsmouth City Overview
Portsmouth Circuit Court Family Records
The Portsmouth Circuit Court sits in the 3rd Judicial Circuit and is the primary court for divorce, property division, and spousal support cases in the city. When residents file for divorce, all pleadings, financial disclosures, and final orders become part of the permanent record maintained by the Clerk of Circuit Court at 601 Crawford Street.
Divorce in Portsmouth is governed by Chapter 6 of Title 20 of the Virginia Code. Under § 20-91, a no-fault divorce is available after one year of living separate and apart. That period drops to six months if the couple has no minor children and has signed a written separation agreement. Fault-based grounds include adultery, cruelty, willful desertion, and felony conviction with imprisonment. The Circuit Court divides marital property under § 20-107.3, which calls for equitable distribution based on the nature of the asset, each party's contributions, and other relevant considerations.
Spousal support is determined under § 20-107.1. The court weighs both parties' incomes, earning capacity, the length of the marriage, the standard of living, and other factors before setting an award. All filed records are open to the public under § 17.1-208 unless sealed.

J&DR Court: Custody, Support, and Protective Orders
The Portsmouth Juvenile and Domestic Relations District Court handles all custody, visitation, child support, paternity, and protective order matters. It is located in the same building as the Circuit Court. Matters involving children and family members that don't go before a jury are handled here first.
The J&DR Court functions under Chapter 11 of Title 16.1. Section 16.1-241 gives this court exclusive original jurisdiction over custody and visitation petitions, support cases, paternity proceedings, and family abuse protective orders. Parents must file custody or support petitions here unless the matter is part of an active Circuit Court divorce case.
Child support is calculated under § 20-108.2 using both parents' gross monthly incomes. The formula accounts for the custody arrangement and can be adjusted for certain expenses. Support may continue past age 18 for full-time high school students, up to age 19.

Child Custody Standards in Portsmouth
Custody decisions in Portsmouth are governed by the best interests of the child standard in § 20-124.2 and § 20-124.3. Virginia does not favor either parent by gender or age. The court focuses entirely on the child's welfare.
The factors courts consider include the child's age and physical condition, each parent's physical and mental condition, the relationship between each parent and the child, the child's need for stable connections with siblings and extended family, each parent's history of involvement in childcare, each parent's willingness to support the other's relationship with the child, and any history of family abuse or sexual abuse. The child's preference is considered if the child is mature enough to express a reasonable opinion.
Section 20-124.4 requires parents in contested custody cases to attend a dispute resolution orientation session before trial. Mediation helps many Portsmouth families reach agreements without a full hearing. Under § 20-124.5, a parent who plans to move with the child must give the other parent at least 30 days written notice. A planned relocation can be treated as a change in circumstances that justifies a custody review.
Child Support Enforcement in Portsmouth
Portsmouth residents can get help with child support through the Division of Child Support Enforcement at the Virginia Department of Social Services. The Division can locate a non-custodial parent, establish paternity, get a support order, and enforce it through income withholding, tax intercepts, license suspension, and credit reporting. Administrative orders issued under § 63.2-1903 have the same legal force as court orders.
Interstate cases involving parents in different states are handled under UIFSA in Chapter 5.3 of Title 20. Family court records are kept for at least 20 years under § 17.1-213.
