Roanoke City Overview
Roanoke Circuit Court Family Records
The Roanoke City Circuit Court is in the 23rd Judicial Circuit and has original jurisdiction over divorce, property division, and spousal support cases. Located at 315 W Church Ave SW, this court maintains all filed family law documents as permanent public records. The Clerk of Circuit Court handles requests for access and copies.
Divorce cases follow Chapter 6 of Title 20 of the Virginia Code. Under § 20-91, a no-fault divorce is available after one year of continuous separation. If there are no minor children and the parties have a signed separation agreement, the waiting period is six months. Fault grounds include adultery, cruelty, willful desertion, and felony conviction. Property is distributed under § 20-107.3 using an equitable division framework that considers the nature of each asset, each spouse's contributions, and other relevant factors.
Spousal support orders follow § 20-107.1, which directs courts to weigh both parties' incomes and earning capacity, the standard of living during the marriage, the length of the marriage, and other factors. All filed records are public under § 17.1-208 unless sealed.

J&DR Court: Custody, Support, and Protective Orders
The Roanoke City Juvenile and Domestic Relations District Court handles custody, visitation, child support, paternity, and protective order matters. It is in the same courthouse as the Circuit Court at 315 W Church Ave SW. Most family matters involving children or domestic relations that don't need a jury are filed here.
The J&DR Court operates under Chapter 11 of Title 16.1. Section 16.1-241 grants this court exclusive original jurisdiction over custody petitions, support cases, paternity proceedings, and family abuse protective orders. Parents who want to start or change a custody or support arrangement must file here unless the case is part of an active Circuit Court divorce proceeding.
Child support is set under § 20-108.2. The formula uses both parents' gross monthly incomes and adjusts for the custody arrangement, work-related childcare costs, and health insurance. Support may extend past age 18 for full-time high school students up to age 19.

How to Request Roanoke Family Court Records
Most family court records in Roanoke are public. You can get them in person at the courthouse, by mail, or through the Virginia Judicial System's free online search tool.
The Virginia case information portal lets you search by party name or case number and see case status and hearing dates for both Circuit Court and J&DR cases. It does not show document images. For copies of filings, contact the Circuit Court Clerk or J&DR Court at the W Church Ave address.
In-person requests are handled at the courthouse during business hours. Bring the name of at least one party and the approximate year the case was filed. Copy fees are set by § 17.1-275. Certified copies cost more than plain copies and require a written request. Mail requests must include the case details, your contact information, and payment or a fee estimate request. The clerk has up to 30 days under § 17.1-208(F) to respond, though most are handled faster.

Child Custody Standards in Roanoke
Custody decisions in Roanoke follow the best interests of the child standard in § 20-124.2 and § 20-124.3. Virginia law does not favor either parent. The court considers only the child's welfare.
The statutory factors include the child's age and physical condition, each parent's physical and mental health, the relationship between each parent and the child, the child's need for consistent relationships with siblings and extended family, each parent's role in past caregiving, each parent's willingness to support the other's relationship with the child, and any history of family abuse or sexual abuse. The child's preference is considered when the child is mature enough to express a reasonable view.
Section 20-124.4 requires parents in contested custody cases to attend a dispute resolution orientation before trial. Mediation is common in Roanoke and helps many families reach agreements outside of court. Under § 20-124.5, a parent planning to relocate with the child must give the other parent at least 30 days written notice. A planned move can serve as a basis to review the existing custody order.
Child Support Enforcement in Roanoke
Roanoke residents can access child support services through the Division of Child Support Enforcement at the Virginia Department of Social Services. Services are available to any parent or caretaker and include paternity establishment, support order creation, and enforcement through income withholding, tax intercepts, license suspension, and credit reporting. Administrative orders under § 63.2-1903 carry the same force as court orders. Interstate cases are handled under UIFSA in Chapter 5.3 of Title 20.
Family court records in Roanoke are kept for at least 20 years under § 17.1-213, so older cases remain accessible long after they close.
