25th Circuit Court: Divorce and Property Cases
The 25th Circuit Court at the Augusta County Courthouse in Staunton handles divorce cases for Waynesboro residents. The Circuit Court has exclusive original jurisdiction over dissolution of marriage, equitable distribution, and spousal support. Divorce filings and all related court papers are part of the permanent public record held by the Clerk of Circuit Court.
Divorce in Waynesboro cases follows Chapter 6 of Title 20 of the Virginia Code. Under § 20-91, a no-fault divorce requires spouses to live separate and apart without cohabitation for at least one year. With a signed separation agreement and no minor children, the waiting period drops to six months. Fault grounds available include adultery, cruelty, willful desertion, and conviction of a felony with confinement for at least a year.
Property is divided under § 20-107.3. The court classifies all assets and debts as marital, separate, or hybrid, then divides the marital estate equitably. Equitable does not mean equal. The judge considers the length of the marriage, each spouse's contributions, the tax consequences of distribution, and each party's debts and financial condition, among other factors.
Spousal support follows § 20-107.1. The court weighs both parties' needs and earning capacity, the duration and standard of living of the marriage, the contributions each spouse made, and other relevant factors. Support may be periodic, lump sum, or a combination, and may be set for a defined term or without a fixed end date. Either party can later seek modification if there is a material change in circumstances.

J&DR Court: Custody, Support, and Protective Orders
The Waynesboro J&DR Court is located on W Main St in Waynesboro. This court handles custody and visitation petitions, child support cases, paternity actions, juvenile matters, and domestic abuse protective orders for Waynesboro residents. Its authority is established under Chapter 11 of Title 16.1.
Under § 16.1-241, the J&DR Court has exclusive original jurisdiction over custody and support cases that are not part of a pending divorce in Circuit Court. The J&DR Court issues emergency protective orders, preliminary protective orders, and final protective orders in family abuse cases under § 16.1-253.2.
Child support is calculated using the income shares formula in § 20-108.2. The formula takes both parents' gross monthly incomes, adds childcare and health insurance costs, and divides the total obligation between the parents proportionally. The resulting amount is presumed to be correct. A deviation requires a written finding from the judge explaining why the standard amount would be unjust.

Child Custody Standards for Waynesboro Cases
Custody decisions for Waynesboro residents follow the best interests of the child standard under § 20-124.2 and § 20-124.3. Virginia law does not favor either parent based on sex or age. Courts focus entirely on the child's welfare when making custody decisions.
The statutory factors include the child's age and physical and mental condition; each parent's age and condition; the quality of the relationship between each parent and the child; the child's need for stability and ties to siblings and extended family; the degree to which each parent has been involved in raising the child; each parent's willingness to support the other parent's relationship with the child; the child's own preference if old enough to express a reasonable view; and any history of family abuse or sexual abuse.
Section 20-124.4 requires courts to refer parents to dispute resolution orientation before a contested custody hearing can proceed. Certified mediators run these sessions at no cost. Many Waynesboro custody matters settle through mediation, which is faster and generally produces more stable outcomes than a contested trial.
Child Support Enforcement for Waynesboro Residents
Waynesboro residents can contact Virginia's Division of Child Support Enforcement to establish, modify, or collect child support. Services are available to all families. The Division establishes paternity through genetic testing, creates administrative support orders under § 63.2-1903, and enforces orders through income withholding, tax refund interception, and license suspension.
Interstate support cases are handled under UIFSA as codified in Chapter 5.3 of Title 20. If the other parent lives in another state, the Division can still pursue enforcement through the appropriate interstate channels. Under § 17.1-213, civil court records are kept for at least 20 years, giving long-term access to support enforcement history.
