Bland County Circuit Court Family Records

The Bland County Circuit Court is part of the 27th Judicial Circuit. The Clerk of Circuit Court at 612 Main St maintains all records for divorce cases, equitable distribution proceedings, and spousal support orders filed in Bland County.

Divorce in Virginia is governed by Chapter 6 of Title 20. Under § 20-91, a no-fault divorce is available after one year of living separate and apart without cohabitation. If the parties have no minor children and have executed a written separation agreement, the waiting period is six months. Fault-based divorce grounds include adultery, cruelty, willful desertion, and felony conviction with imprisonment.

The court divides marital property under § 20-107.3 by classifying all assets and debts, assigning values, and making an equitable award based on the specific circumstances of the marriage. The court considers factors such as how long the marriage lasted, each spouse's contributions to the marital estate, and each party's economic needs and resources. Spousal support under § 20-107.1 looks at income, earning capacity, and the standard of living during the marriage.

J&DR Court: Custody, Support, and Protective Orders

The Bland County Juvenile and Domestic Relations District Court is in the same building. The J&DR Court operates under Chapter 11 of Title 16.1 and has exclusive original jurisdiction over child custody, visitation, support, paternity, and protective order matters in Bland County.

Under § 16.1-241, parents who want to establish, modify, or enforce custody or support orders file petitions in the J&DR Court unless the matter is already part of an open divorce case. J&DR Court orders are fully enforceable and may be appealed to the Circuit Court for a new hearing. The J&DR Court also handles emergency protective orders requested during business hours.

Child support is calculated using the income shares guidelines in § 20-108.2. The formula takes both parents' gross incomes, the custody arrangement, health insurance costs, and work-related childcare expenses. It produces a monthly support obligation based on each parent's share of the combined income. Orders are subject to modification when a material change in circumstances has occurred.

Note: Family abuse protective orders in Bland County are issued under § 16.1-253.2. Emergency protective orders are available through the on-duty magistrate at any time.

How to Request Bland County Family Court Records

Family court records in Bland County are generally open to the public. You can get them in person at the courthouse in Bland, by mailing a written request, or by searching online through the Virginia statewide case system.

The free online search tool at eapps.courts.state.va.us covers both Circuit Court and J&DR cases across Virginia. Search by party name or case number to see case status, hearing dates, and basic case details. The tool does not show document images. To get copies of filed documents, contact the clerk's office.

For in-person requests, go to the Bland County Courthouse at 612 Main St during regular business hours. Bring the full name of at least one party and the approximate filing year. The clerk can find the record and provide copies at the rates set under § 17.1-275. Certified copies cost more and need a specific written request.

Mail requests should include party names, the case number if known, the year the case was filed, your mailing address, and payment or a request for a cost estimate. The clerk has up to 30 days to respond under § 17.1-208(F).

Types of Family Court Records in Bland County

Bland County courts hold a range of family law records. Circuit Court divorce files typically include the complaint, financial disclosure statements, any property settlement agreement, and the final decree. In contested cases, the file may also have motions, exhibits, and hearing notes.

  • Divorce decrees and final orders
  • Property settlement agreements
  • Custody and visitation orders
  • Child support orders and income withholding orders
  • Protective orders under § 16.1-253.2
  • Paternity orders and acknowledgments
  • Spousal support orders
  • Marriage licenses issued by the Circuit Court clerk

Some records are sealed. Adoption files, juvenile delinquency records, and child abuse or neglect cases are not open to the public. To access sealed records, you must file a formal motion with the court and show good cause. The judge decides whether to grant access.

Child Custody Standards in Bland County

Custody decisions in Bland County are made using the best interests of the child standard under § 20-124.2 and § 20-124.3. Virginia law does not presume that either parent is the better custodian. The court examines each child's full situation before deciding.

Courts weigh several statutory factors: the child's age and physical condition, the mental and physical health of each parent, the quality of each parent's bond with the child, the child's relationships with siblings and extended family, each parent's record of daily involvement in the child's care, each parent's willingness to support the other's role in the child's life, any reasonable preference expressed by the child, and any history of family abuse. No single factor controls the outcome.

Under § 20-124.4, courts must refer parents to a dispute resolution orientation before a contested custody case goes to trial. These sessions are run by certified mediators and are free or low cost. Mediation often leads to agreed custody arrangements that are more durable than orders handed down after a contested hearing and tend to be less difficult for children.

Under § 20-124.5, a parent planning to relocate with a child must give the other parent at least 30 days of written notice. Failing to give notice can be treated as a material change in circumstances and used to seek a custody modification.

Virginia Child Support Enforcement Services

Bland County residents can access child support services through the Virginia Division of Child Support Enforcement (DCSE). DCSE is part of the Department of Social Services and helps parents establish paternity, obtain support orders, and collect payments. Any parent or caretaker can apply regardless of income.

DCSE can establish paternity through genetic testing, enter administrative support orders under § 63.2-1903, collect payments through income withholding, intercept tax refunds, suspend driver's licenses for non-payment, and report delinquent parents to credit bureaus. Administrative orders have the same legal weight as court orders. Contact the Bland County Department of Social Services to apply for these services.

Note: Interstate support matters are handled under the Uniform Interstate Family Support Act at Chapter 5.3 of Title 20.

Civil case files in Bland County are retained for at least 20 years from the date of the last order under § 17.1-213. Older divorce and custody records remain accessible long after the cases are closed, which is useful when you need to verify past support amounts or review old custody terms.
