Charles City County Circuit Court Family Records

The Charles City County Circuit Court is part of Virginia's 9th Judicial Circuit. This court has original jurisdiction over all divorce cases filed by Charles City County residents. The Clerk of Circuit Court maintains the permanent record for each case, including all filed documents from the initial complaint through the final decree.

Virginia's divorce statutes are found in Chapter 6 of Title 20. Section 20-91 sets out the grounds for divorce. A no-fault divorce requires one year of continuous separation. If the parties have no minor children and have signed a written separation agreement, the waiting period is six months. Fault grounds like adultery, cruelty, and willful desertion are also available.

Property division follows § 20-107.3, which requires the court to classify all assets and debts as separate, marital, or hybrid, then divide the marital estate equitably. This does not always mean equally. The judge weighs the length of the marriage, each spouse's contributions, and other factors. Spousal support is determined under § 20-107.1 using a list of factors that include each party's needs, earning capacity, and standard of living during the marriage. All orders become part of the public court record maintained by the clerk under § 17.1-208.

J&DR Court: Custody, Support, and Protective Orders

The Charles City County Juvenile and Domestic Relations District Court operates from the same courthouse on Courthouse Road. This court handles custody petitions, child support orders, paternity actions, visitation disputes, and family abuse protective orders. Most family cases that do not involve a pending divorce begin in the J&DR Court.

The J&DR Court's authority derives from Chapter 11 of Title 16.1. Under § 16.1-241, the court has exclusive original jurisdiction over custody and support matters when no divorce is active in Circuit Court. If you need a custody order outside of a divorce proceeding, you must petition the J&DR Court.

Child support calculations in Charles City County use the income shares guidelines in § 20-108.2. Both parents' gross monthly incomes factor into the formula, along with the number of children and the custody arrangement. Judges can depart from the guidelines only with written findings showing why the standard amount would be unjust.

Note: Family abuse protective orders in Charles City County are available under § 16.1-253.2. Emergency orders are issued by the on-duty magistrate and available 24 hours a day.

Mail requests should include the party names, the case number if known, the documents you need, and a payment or fee inquiry. The clerk has up to 30 days to respond under § 17.1-208(F). Most requests are handled before the 30-day mark.

Child Custody Standards in Charles City County

Custody in Charles City County is determined by the best interests of the child standard under § 20-124.2 and § 20-124.3. Neither parent has a presumptive advantage. The judge looks at the full situation and makes a decision tailored to the specific child and family.

The statutory factors include the child's age and condition, each parent's age and condition, each parent's relationship with the child, the child's needs and family ties, the roles each parent has played in raising the child, each parent's willingness to support the child's relationship with the other parent, any preference the child can express, and any history of abuse or neglect.

Before contested custody cases go to hearing, § 20-124.4 directs courts to refer parents to a dispute resolution orientation. These sessions are led by certified mediators. Many Charles City County families reach custody agreements through this process, which avoids a contested trial and tends to produce more lasting arrangements.

If a parent wants to move with the child, § 20-124.5 requires at least 30 days of written notice to the other parent. Moving without proper notice can be treated as a change in circumstances that justifies a custody modification.

Administrative orders carry the same weight as court orders. Interstate matters are handled under UIFSA, found in Chapter 5.3 of Title 20.

Note: Under § 17.1-213, civil case files in Charles City County are retained for at least 20 years from the date of the final order, so older divorce and custody records remain accessible.
