J&DR Court: Custody, Support, and Protective Orders
The Isle of Wight County Juvenile and Domestic Relations District Court is located in the same courthouse building. It handles custody and visitation petitions, child support cases, paternity determinations, and family abuse protective orders. The court operates under Chapter 11 of Title 16.1.
Section 16.1-241 gives the J&DR Court exclusive original jurisdiction over custody, support, and protective order cases that are not already part of a Circuit Court divorce proceeding. A parent seeking to establish or modify custody outside of a divorce must file a petition here. Both parties receive notice, and the court schedules a hearing. If the case is contested, a guardian ad litem may be appointed to represent the child's interests.
Child support amounts follow § 20-108.2. Both parents' gross incomes are combined and support is set based on that total and the custody arrangement. Work-related childcare costs and health insurance premiums can be added to the base amount. The J&DR Court issues wage withholding orders to collect support directly from a parent's paycheck when needed.

How to Request Isle of Wight County Family Court Records

If one parent wants to relocate with the child, § 20-124.5 requires 30 days written notice to the other parent. Moving without notice can lead to a custody modification proceeding.
