The Montgomery County Circuit Court in Christiansburg handles all divorce filings, property division disputes, and spousal support matters for the county. Every document filed in a divorce proceeding becomes part of the permanent public record kept by the Clerk of Circuit Court at 55 E Main St.

Virginia divorce law is set out in Chapter 6 of Title 20. Under § 20-91, a no-fault divorce requires at least one year of living separate and apart. J&DR Court: Custody, Support, and Protective Orders

The Montgomery County Juvenile and Domestic Relations District Court is located at the same address at 55 E Main St in Christiansburg. The J&DR Court handles child custody and visitation petitions, child support establishment and enforcement, paternity cases, juvenile matters, and family abuse protective orders.

The J&DR Court's authority comes from Chapter 11 of Title 16.1. Section 16.1-241 gives this court exclusive original jurisdiction over custody, support, and protective order matters not tied to an active Circuit Court divorce case. Child support in Montgomery County is calculated using the income shares guidelines in § 20-108.2. The court combines both parents' gross incomes to determine the total support obligation, then assigns each parent a proportional share. Support can extend past age 18 for children who remain full-time high school students, up to their 19th birthday.

The state's online case search lets you find cases by party name or case number and view basic information including filing dates, hearing schedules, and case status for both Circuit Court and J&DR matters. Document images are not available online. To get copies of filed documents, contact the clerk's office directly.

In-person requests are handled during regular business hours at 55 E Main St. Have the full name of at least one party and the approximate year of filing ready. The clerk finds the case and provides copies at fees under § 17.1-275. Certified copies require a specific written request and carry higher fees than plain copies.

Mail requests should include party names, the filing year, your mailing address, and payment or a cost estimate request. The clerk has up to 30 days to respond under § 17.1-208(F), though many requests are filled faster.

Types of Family Court Records in Montgomery County

Circuit Court divorce files in Montgomery County generally contain the complaint for divorce, any counterclaim, financial disclosure statements, property settlement agreements, and the final divorce decree. Access to restricted records requires filing a motion with the court and showing good cause. The judge decides whether to grant access based on the specific circumstances of the request.

Child Custody Standards in Montgomery County

Courts in Montgomery County decide custody based on the best interests of the child standard in § 20-124.2 and § 20-124.3. Virginia law does not presume that either parent is more suitable for custody. The child's welfare is the central concern.

Judges must consider ten statutory factors: the child's age and physical and mental condition, each parent's age and health, the quality of each parent's relationship with the child, the child's ties to siblings and extended family, each parent's role in raising the child up to that point, each parent's willingness to support the child's ongoing relationship with the other parent, any reasonable preference expressed by a child old enough to have a considered view, and any history of abuse or violence.

Section 20-124.4 requires parents in contested custody disputes to attend a dispute resolution orientation before trial. Certified mediators run these sessions. Mediation often helps parents reach their own agreements, which is less stressful on children and tends to produce arrangements that last longer than those ordered after contested hearings.

Relocation notice is required. Under § 20-124.5, a custodial parent who plans to move with the child must give the other parent written notice at least 30 days in advance. Failing to do so can be grounds for a custody modification proceeding.

Virginia Child Support Enforcement Services

Montgomery County residents can get help with child support through Virginia's Division of Child Support Enforcement, part of the Department of Social Services. The Division operates statewide and provides services at no cost regardless of the applicant's income level.

The Division can establish paternity through genetic testing, obtain administrative support orders under § 63.2-1903, enforce orders via income withholding, intercept state and federal tax refunds, suspend driver's licenses and other licenses, and report delinquent parents to credit bureaus. Administrative orders are as legally binding as court orders. Interstate support matters follow UIFSA, codified in Chapter 5.3 of Title 20.

Note: Civil family court records in Montgomery County are retained for at least 20 years from the date of the last court order under § 17.1-213, keeping older divorce and custody files accessible well after cases end.

Virginia Vital Records for Montgomery County
