Northampton County Circuit Court Family Records

The Northampton County Circuit Court in Eastville handles all divorce filings, property division, and spousal support matters for the southern end of Virginia's Eastern Shore. Every document filed in a divorce case becomes part of the permanent public record kept by the Clerk of Circuit Court.

Virginia divorce law is found in Chapter 6 of Title 20. Under § 20-91, a no-fault divorce is available after one year of living separate and apart. J&DR Court: Custody, Support, and Protective Orders

The Northampton County Juvenile and Domestic Relations District Court is co-located with the Circuit Court on The Horns in Eastville. This court handles child custody and visitation petitions, child support orders, paternity determinations, juvenile matters, and family abuse protective orders for Northampton County families.

The J&DR Court's authority comes from Chapter 11 of Title 16.1. Under § 16.1-241, this court has exclusive original jurisdiction over custody, support, and protective order matters not tied to an active Circuit Court divorce proceeding. In-person requests are handled Monday through Friday during business hours. Bring the full name of at least one party and the approximate year of filing. The clerk locates the case and provides copies at rates set by § 17.1-275. Certified copies require a written request and cost more than plain copies.

Mail requests should include party names, the approximate filing year, your return address, and payment or a request for a fee estimate. Under § 17.1-208(F), the clerk has up to 30 days to respond, though many requests are processed sooner.

Child Custody Standards in Northampton County

Custody decisions in Northampton County are made under the best interests of the child standard in § 20-124.2 and § 20-124.3. Virginia courts do not presume either parent has an advantage. The child's welfare is the primary concern.

Judges must consider ten statutory factors: the child's age and physical and mental condition, each parent's age and health, the quality of each parent's relationship with the child, the child's ties to siblings and extended family, the historical role each parent has played in raising the child, each parent's willingness to support the child's relationship with the other parent, the reasonable preference of a child old enough to express one, and any history of abuse.

Section 20-124.4 requires parents in contested custody cases to attend a dispute resolution orientation before trial. Mediators run these sessions at no cost. Mediation often resolves disputes without a full hearing, which is less stressful for children and tends to produce lasting arrangements.

Under § 20-124.5, a custodial parent who plans to relocate with the child must give the other parent written notice at least 30 days before the move. Failing to provide this notice can be treated as a material change in circumstances and could lead to a custody modification hearing.

Virginia Child Support Enforcement Services

Northampton County residents can use Virginia's Division of Child Support Enforcement for help with child support. The Division is part of the Department of Social Services and provides services statewide at no cost to applicants.

The Division can establish paternity through genetic testing, obtain administrative support orders under § 63.2-1903, enforce orders through income withholding, intercept tax refunds, suspend licenses, and report delinquent parents to credit bureaus. Administrative orders are as binding as court orders. Interstate support cases follow UIFSA under Chapter 5.3 of Title 20.

Note: Civil family court records in Northampton County are kept for at least 20 years from the date of the last court order under § 17.1-213, so older divorce and custody files remain accessible after cases are closed.
