Divorce proceedings in Powhatan County follow Chapter 6 of Title 20 of the Virginia Code. Under § 20-91, a no-fault divorce requires one year of living separate and apart, reduced to six months when there are no minor children and the parties have a signed separation agreement. J&DR Court: Custody, Support, and Protective Orders
The Powhatan County Juvenile and Domestic Relations District Court is in the same building as the Circuit Court on Old Buckingham Road. It handles custody and visitation petitions, child support cases, paternity determinations, juvenile matters, and family abuse protective orders under Chapter 11 of Title 16.1.
Section 16.1-241 gives this court exclusive original jurisdiction over custody, support, and protective order cases involving family and household members. Parents who want to establish or change a custody or support arrangement outside of a pending divorce case must file in the J&DR Court. This is also the court that handles emergency protective orders and juvenile delinquency petitions.
Child support is set using the guidelines in § 20-108.2. The formula factors in both parents' gross incomes, the custody arrangement, health insurance costs, and work-related childcare expenses. Support may continue past age 18 for children who remain full-time high school students, up to age 19.

How to Request Powhatan County Family Court Records
Most family court records in Powhatan County are public. You can access them in person at the courthouse on Old Buckingham Road, by mail, or through Virginia's free online case information portal.
The Virginia Judicial System's online tool lets you search by party name or case number. It shows case status, filing dates, and upcoming hearing dates. It does not provide document images. To get copies of filed documents, you must contact the clerk's office.
In-person requests during business hours are typically the fastest method. Bring the full name of at least one party and the approximate year the case was filed. The clerk will locate the file and quote a copy fee under § 17.1-275. Certified copies require a written request and cost more than standard copies.
Mail requests should include party names, the case year, your contact information, and either a payment or a fee estimate request. The clerk has up to 30 days to respond under § 17.1-208(F). Case files are retained for at least 20 years under § 17.1-213.

Adoption files and certain juvenile records are sealed by law. If you need access to a sealed file, file a motion with the court and show good cause. The judge will decide whether to grant access.
Child Custody Standards in Powhatan County
Custody in Powhatan County is decided under the best interests of the child standard in § 20-124.2 and § 20-124.3. Virginia courts do not favor either parent based on gender or any factor unrelated to the child's welfare.
The ten statutory factors include the child's age and physical needs, each parent's age and condition, the parent-child relationship for each parent, the child's bonds with siblings and other family, the role each parent has played in daily caregiving, each parent's willingness to support the other's relationship with the child, the child's reasonable preference when old enough to express one, and any history of family abuse or neglect.
Section 20-124.4 requires parents to attend a dispute resolution orientation before a contested custody case goes to trial. Certified mediators run these sessions at no cost. Many Powhatan County families settle custody matters in these sessions without a contested hearing.
A parent planning to relocate with the child must give the other parent at least 30 days written notice under § 20-124.5. Moving without notice can be treated as a material change supporting a custody modification.
Virginia Child Support Enforcement Services
Powhatan County residents can use the Virginia Division of Child Support Enforcement to establish, modify, or collect child support. Services are available to all parents and caretakers statewide.
The Division establishes paternity through genetic testing, creates administrative support orders under § 63.2-1903, and enforces payment through income withholding, tax refund intercepts, driver's license suspension, and credit bureau reporting. Administrative orders have the same legal force as court orders. Interstate matters are handled under UIFSA, adopted under Chapter 5.3 of Title 20.
