The Buchanan County Circuit Court is in the 29th Judicial Circuit, which covers the coalfield region of far Southwest Virginia. The Clerk of Circuit Court in Grundy maintains all records for divorce cases, equitable distribution proceedings, and spousal support orders filed in Buchanan County.
Virginia divorce law is set out in Chapter 6 of Title 20. Under § 20-91, a no-fault divorce requires the parties to have lived separate and apart for one continuous year. That period drops to six months if there are no minor children and the parties have entered a written separation agreement. Fault grounds include adultery, cruelty, willful desertion, and felony conviction with imprisonment.
The court divides marital assets and debts under § 20-107.3. Each asset and debt must be classified, valued, and distributed fairly based on the facts of the case. J&DR Court: Custody, Support, and Protective Orders
The Buchanan County Juvenile and Domestic Relations District Court is located in the same courthouse in Grundy. Under Chapter 11 of Title 16.1, the J&DR Court has exclusive original jurisdiction over child custody and visitation, support, paternity, and protective order matters in Buchanan County.
Section 16.1-241 outlines the J&DR Court's scope. Parents who need to establish or modify custody or support file petitions here unless the matter is already before the Circuit Court in a pending divorce. J&DR orders are enforceable and can be appealed to the Circuit Court for a fresh hearing.
Child support is calculated using the income shares guidelines in § 20-108.2. The formula uses both parents' gross incomes, the custody arrangement, health insurance costs, and work-related childcare expenses. The court can depart from the guidelines when applying them would produce an unjust result. Support orders can be modified when a material change in circumstances has occurred.

Child Custody Standards in Buchanan County

The Virginia Division of Child Support Enforcement (DCSE) serves Buchanan County residents. DCSE helps parents establish paternity, obtain support orders, and collect payments when the other parent stops paying. Any parent or caretaker can use the service regardless of income.
DCSE can establish paternity through genetic testing, issue administrative support orders under § 63.2-1903, collect support through income withholding, intercept state and federal tax refunds, suspend driver's licenses for non-payment, and report delinquent parents to credit bureaus.
