Russell County Overview
Russell County Circuit Court Family Records
The Russell County Circuit Court is the court of record for divorce, property division, and spousal support cases in the 29th Judicial Circuit. When a divorce case is filed in Russell County, all pleadings, agreements, and final orders become part of the permanent file maintained by the Clerk of Circuit Court in Lebanon.
Divorce cases in Russell County follow Chapter 6 of Title 20 of the Virginia Code. Under § 20-91, a no-fault divorce requires the parties to live separate and apart for one year, or six months if there are no minor children and the parties have signed a written separation agreement. Fault grounds include adultery, cruelty, willful desertion, and felony conviction with resulting imprisonment. The Circuit Court also handles equitable distribution of marital property under § 20-107.3, requiring classification, valuation, and division of all marital assets and debts.
Spousal support is governed by § 20-107.1. The court weighs the needs and obligations of each party, the standard of living during the marriage, how long the marriage lasted, the age and health of each spouse, and each party's ability to earn income. All records filed with the Circuit Court are public under § 17.1-208, with narrow exceptions for sealed or restricted matters.

J&DR Court: Custody, Support, and Protective Orders
The Russell County Juvenile and Domestic Relations District Court is located in the same building as the Circuit Court at 79 E Main St in Lebanon. This court handles child custody, visitation, child support, paternity, juvenile matters, and family abuse protective orders under Chapter 11 of Title 16.1.
Section 16.1-241 gives the J&DR Court exclusive original jurisdiction over custody, visitation, support, and protective order matters. If a custody or support issue arises outside of a pending divorce, it must be filed here. Child support amounts are calculated using the guidelines in § 20-108.2, which base the award on the gross incomes of both parents and the custody arrangement. Support for children still in high school can continue past age 18 until the child graduates or turns 19.
Protective orders for family abuse are available through this court under § 16.1-253.2. Emergency protective orders can be issued by a magistrate at any hour when the court is not in session. Violation of a protective order is a criminal offense under § 16.1-253.2(F).
Note: The J&DR Court in Lebanon shares the courthouse address with the Circuit Court. Call (276) 889-8023 to confirm which clerk handles the type of record you need.
How to Request Russell County Family Court Records
Family court records in Russell County are open to the public unless a court has ordered them sealed. You can search and request records in three ways: visit the courthouse in Lebanon, submit a written mail request, or search online using the Virginia Judicial System's free case information portal.
The Virginia Judicial System provides a statewide online case search tool at no charge. You can look up cases by party name or case number for both Circuit Court and J&DR cases. The online tool shows case status, filing dates, and scheduled hearings but does not provide document images. To get copies of actual court filings, you need to contact the clerk's office directly.
If you visit in person, bring the full name of at least one party and the approximate year the case was filed. Clerks can locate the case and make copies on the spot. Copy fees are set under § 17.1-275 and are based on actual duplication costs. Certified copies cost more and require a written request specifying the document you need.
For mail requests, include the party names, the approximate filing year, your contact information, and either payment or a request for a fee estimate. Under § 17.1-208(F), the clerk has up to 30 days to respond, but most requests are handled faster. Send mail requests to 79 E Main St, Lebanon, VA 24266.

Child Custody Standards in Russell County
Custody determinations in Russell County follow the best interests of the child standard under § 20-124.2 and § 20-124.3. Virginia courts do not prefer one parent over the other based on gender or age. The focus is entirely on what arrangement will best serve the child's welfare, safety, and development.
The ten statutory factors courts consider include the age and physical condition of the child, the age and physical condition of each parent, the relationship each parent has built with the child, the needs of the child including the importance of continuing sibling and extended family relationships, the role each parent has played in raising the child, how willing each parent is to support the child's relationship with the other parent, the reasonable preference of the child if mature enough to express one, and any history of family abuse. Courts may also consider other relevant factors not listed in the statute.
Under § 20-124.4, most parties in custody disputes must attend a dispute resolution orientation session before the case proceeds to a contested hearing. These sessions are often free and are conducted by certified mediators. Many families reach workable agreements through mediation without going to trial, which tends to reduce conflict and produce more stable custody arrangements over time.
If one parent wants to relocate with the child, § 20-124.5 requires at least 30 days written notice to the other parent. Courts treat failure to give notice as a factor that weighs against the relocating parent.
