Clarke County Overview
Clarke County Circuit Court Family Records
The Clarke County Circuit Court is located in Berryville and is part of the 26th Judicial Circuit. The Circuit Court has exclusive original jurisdiction over all divorce proceedings in Clarke County. The Clerk of Circuit Court maintains permanent case files that include all filed documents: complaints, answers, financial disclosures, property settlement agreements, and final decrees.
Virginia divorce law is found in Chapter 6 of Title 20. Under § 20-91, a no-fault divorce is available after one year of continuous separation. The period shortens to six months when there are no minor children and the parties have a written separation agreement. Fault grounds remain available for appropriate situations.
Equitable distribution of marital property follows § 20-107.3. The court classifies assets and debts, determines their value, and divides the marital estate fairly. Clarke County cases often involve rural real property, agricultural interests, and retirement accounts. Spousal support is addressed under § 20-107.1, which requires the judge to weigh factors like each party's earning capacity, the standard of living during the marriage, and the duration of the marriage. Records are open to the public under § 17.1-208 unless sealed by law.

J&DR Court: Custody, Support, and Protective Orders
The Clarke County Juvenile and Domestic Relations District Court operates from the same courthouse at 102 N Church St in Berryville. The J&DR Court handles custody petitions, child support proceedings, paternity actions, visitation disputes, juvenile matters, and requests for family abuse protective orders.
The court's jurisdiction comes from Chapter 11 of Title 16.1. Section 16.1-241 gives the J&DR Court exclusive original jurisdiction over custody and support matters when no divorce case is active in Circuit Court. Parents who need a custody or support order without filing for divorce must come to the J&DR Court first.
Child support guidelines under § 20-108.2 drive support amounts. The formula uses both parents' gross monthly incomes and the custody arrangement. Judges can deviate only with written findings showing why the guideline amount would be unjust in that specific case. Deviations are uncommon and must be clearly justified.
Note: Protective orders in Clarke County are issued under § 16.1-253.2. Emergency protective orders are available through the on-duty magistrate at any time, including nights and weekends.
How to Request Clarke County Family Court Records
Family court records in Clarke County are generally public. There are three main ways to get them: visit the courthouse in Berryville in person, send a written request by mail, or use the free online case search tool provided by the Virginia Judicial System.
The Virginia Judicial System case search covers both Circuit Court and J&DR cases statewide. It is free to use and lets you search by party name or case number. You will see basic case data, hearing dates, and case status, but not actual document images. For copies of filed documents, contact the clerk's office directly.
In-person visits should be made to 102 N Church St in Berryville during regular business hours. Bring the name of at least one party and the approximate year the case was filed. The clerk will find the case and provide copies at the rate set by § 17.1-275. Certified copies require a specific request and a higher fee.
Mail requests must include the party names, case number if known, a description of the documents needed, and payment or a fee inquiry. The clerk has 30 days to respond under § 17.1-208(F), though most requests are handled much faster.
Types of Family Court Records in Clarke County
Clarke County's Circuit Court and J&DR Court together generate a variety of family law records. Circuit Court divorce files are the most detailed and may include financial discovery materials and trial exhibits in contested cases. Uncontested divorces still produce a core set of important documents.

Certain records are sealed or restricted. Adoption files, juvenile delinquency records, and specific abuse and neglect proceedings are not open to the public. To access restricted records, file a motion with the court and demonstrate a legitimate need. The judge will decide whether to allow access.
Child Custody Standards in Clarke County
Custody in Clarke County is determined under the best interests of the child standard established in § 20-124.2 and § 20-124.3. Virginia courts give neither parent a presumptive advantage. Every custody case is decided on its own facts.
The court must weigh ten statutory factors: the child's age and physical condition, each parent's age and physical condition, the relationship each parent has with the child, the child's needs and family connections, the role each parent has played in the child's life, each parent's willingness to support the other parent's bond with the child, any reasonable preference the child can express, and any history of family abuse or neglect. Judges in Clarke County may also hear from teachers, counselors, or other individuals who know the child.
Section 20-124.4 requires courts to refer parents to a dispute resolution orientation before contested custody matters go to trial. Many families in Clarke County reach workable custody agreements through mediation, which saves time and tends to produce more durable arrangements than litigated outcomes.
A parent who plans to relocate with the child must provide at least 30 days of written notice under § 20-124.5. Failure to give notice can be treated as a material change in circumstances that justifies revisiting the custody order.
Virginia Child Support Enforcement Services
Clarke County residents can get free help with child support matters through Virginia's Division of Child Support Enforcement (DCSE). The Division is part of the Department of Social Services and serves any parent or caretaker, regardless of income or public assistance status.
DCSE establishes paternity, creates administrative support orders under § 63.2-1903, and enforces orders through income withholding, tax refund interception, license suspension, property liens, and credit bureau reporting. Administrative orders have the same force as court orders. Interstate support cases are handled under UIFSA, found in Chapter 5.3 of Title 20.
Note: Civil court records in Clarke County are kept for at least 20 years under § 17.1-213, so older divorce and custody records remain available long after cases close.
