Divorce cases in Loudoun County are governed by Chapter 6 of Title 20 of the Virginia Code. Under § 20-91, a no-fault divorce requires spouses to live separate and apart for one year. That period drops to six months if both have signed a written separation agreement and have no minor children. Fault grounds including adultery, cruelty, desertion, and felony conviction remain available. The court divides marital property and debts under the equitable distribution standard in § 20-107.3.

Spousal support in Loudoun County follows § 20-107.1. J&DR Court: Custody, Support, and Protective Orders

The Loudoun County Juvenile and Domestic Relations District Court is also located at the East Market Street courthouse complex in Leesburg. It handles custody and visitation petitions, child support cases, paternity proceedings, juvenile cases, and family abuse protective orders. The court operates under Chapter 11 of Title 16.1.

Section 16.1-241 gives the J&DR Court exclusive original jurisdiction over custody, support, and protective order matters that are not part of an active Circuit Court divorce case. A parent seeking to establish or modify custody outside of a divorce must file a petition here. The court schedules a hearing and both parties are notified. Because Loudoun County has a large population, wait times for hearings can be longer than in smaller counties. Mediation is available and can speed up resolution significantly.

Child support amounts follow § 20-108.2. Both parents' gross incomes are combined to set the total obligation, which is then allocated based on the custody arrangement and adjusted for childcare and health insurance costs. The J&DR Court issues wage withholding orders to collect support directly from employers. In high-income cases common in Loudoun County, the court may deviate from the guidelines if the standard amount would be unjust.

How to Request Loudoun County Family Court Records

Most family court records in Loudoun County are open to the public and can be accessed in person, by mail, or online through the state's free case search tool. In-person access is available at the Leesburg courthouse, which has extended service capacity due to the county's population.

The Virginia Judicial System's online case information system is free to use. Search by party name or case number to find case status, filing dates, and hearing information for Loudoun County cases. Document images are not available through this tool. For copies of filed documents, contact the Circuit Court clerk or J&DR Court clerk directly depending on the case type.

In-person requests at the courthouse are handled during normal business hours. Bring the full name of at least one party and the approximate year of filing. Clerk staff can search the index and pull the file. Copy fees are governed by § 17.1-275 and may not exceed actual costs. Certified copies require a specific written request and cost more.

For mail requests, include both parties' names, the case number if available, the documents needed, your return address, and payment or a fee estimate request. The clerk must respond within 30 days under § 17.1-208(F). Given the volume of cases in Loudoun County, submitting all information upfront will help speed up the process.

The ten statutory factors courts must weigh include the child's age and physical and mental condition, the age and condition of each parent, each parent's relationship with the child, the child's ties to siblings and extended family, each parent's past role in the child's upbringing, each parent's willingness to support the other parent's bond with the child, the child's reasonable preference if old enough to express one, and any history of family abuse or sexual abuse. Courts may also consider additional relevant circumstances.

Section 20-124.4 requires parents in contested custody cases to attend a dispute resolution orientation before trial. These sessions are free and conducted by certified mediators. Many Loudoun County families reach custody agreements through mediation, which can be especially valuable in a high-cost jurisdiction where attorney fees add up quickly. If mediation fails, the case proceeds to a contested hearing.

Under § 20-124.5, a parent who plans to relocate with the child must give 30 days written notice to the other parent. Failure to give notice can result in a modification of the existing custody order.

Virginia Child Support Enforcement Services

Loudoun County residents can use Virginia's statewide child support enforcement program for help collecting, establishing, or modifying support. The Division of Child Support Enforcement within the Department of Social Services provides free services to any parent or caretaker regardless of income.

DCSE can establish paternity through DNA testing, issue administrative support orders under § 63.2-1903, enforce orders through income withholding, intercept tax refunds, suspend driver's and professional licenses, and report delinquent parents to credit bureaus. Administrative orders have the same legal effect as court orders. Loudoun County residents access DCSE through the statewide program.

Note: Interstate support cases involving Loudoun County residents are governed by UIFSA, adopted by Virginia under Chapter 5.3 of Title 20.

Under § 17.1-213, civil case files in Virginia are kept for at least 20 years from the date of the last order. Older Loudoun County family court records remain on file and accessible well after cases have closed.

Virginia Vital Records for Loudoun County
