Gloucester County Circuit Court Family Records

The Gloucester County Circuit Court is part of the 9th Judicial Circuit and has original jurisdiction over divorce, property division, and spousal support matters. The Clerk of Circuit Court maintains all case files and orders at the Gloucester Justice Center, 7400 Justice Dr in Gloucester.

Divorce cases in Gloucester County follow Chapter 6 of Title 20. Under § 20-91, a no-fault divorce is available after a one-year separation period. This is reduced to six months when the parties have a signed separation agreement and no minor children. Fault grounds such as adultery, cruelty, desertion, and felony conviction are also available.

Marital property is divided under § 20-107.3. The court classifies all property as separate, marital, or hybrid, then assigns values and distributes the marital estate equitably. The court considers each spouse's contributions, economic circumstances, the length of the marriage, and other factors. Spousal support follows § 20-107.1. All filed documents are public records under § 17.1-208 unless a court order restricts access.

J&DR Court: Custody, Support, and Protective Orders

The Gloucester County Juvenile and Domestic Relations District Court is located at the same address at 7400 Justice Dr. The J&DR Court handles child custody and visitation petitions, child support, paternity, and family abuse protective orders. It also hears juvenile delinquency and child protective services cases.

Custody cases in the J&DR Court are governed by the best interests standard in § 20-124.2 and the ten-factor analysis in § 20-124.3. The court evaluates the child's age and physical needs, each parent's mental and physical health, the existing relationships between the child and each parent, and whether either parent has a history of abuse. Virginia courts treat both parents equally regardless of gender.

Child support uses the income shares formula in § 20-108.2. The formula combines both parents' gross incomes to calculate the base support amount, then allocates that amount proportionally. Work-related childcare costs and health insurance premiums are added. Courts can depart from the guideline amount when a strict application would be inequitable under the circumstances.

Note: Family abuse protective orders in Gloucester County are issued under § 16.1-253.2. Emergency protective orders are available at all times through the on-duty magistrate.

How to Request Gloucester County Family Court Records

Family court records in Gloucester County can be accessed in person, by mail, or online through Virginia's free case search system. Most records are public under § 17.1-208.

Virginia offers a free online case search at vacourts.gov. You can search by party name or case number and view party information, hearing dates, and case status. The tool does not include scanned documents. For copies of filed pleadings or orders, contact the Gloucester County Circuit Court clerk directly.

In-person requests are handled at the Gloucester Justice Center during business hours. Provide the name of one party and the approximate filing year. The clerk will locate the file and provide copies at the rates set by § 17.1-275. Certified copies require a written request and an additional fee.

For mail requests, send the case name, both parties' names, and the approximate filing year, along with payment or a request for a fee estimate. The clerk must respond within 30 days under § 17.1-208, though many requests are processed faster.

Types of Family Court Records in Gloucester County

The records you can access depend on which court filed the case. Circuit Court divorce records are usually the most detailed, particularly in contested matters. J&DR records focus on custody, support, and protective orders.

  • Divorce complaints and final decrees
  • Property settlement and separation agreements
  • Equitable distribution orders
  • Spousal support orders
  • Child custody and visitation orders
  • Child support orders and income withholding notices
  • Protective orders under § 16.1-253.2
  • Paternity orders and voluntary acknowledgments
  • Modification petitions for custody or support

Some records are restricted and not open to the public. Adoption files, juvenile delinquency records, and child abuse and neglect case files are sealed or limited by law. To access restricted records, you must file a motion with the court and demonstrate a legal basis for access. The judge will determine whether to grant the request.

Child Custody Standards in Gloucester County

Custody and visitation decisions in Gloucester County are based on the best interests of the child. The court does not start with a preference for either parent. Every case is evaluated on its own facts using the factors listed in § 20-124.3.

Those factors include the child's age and physical condition, each parent's mental and physical health, the depth of the parent-child relationship, how involved each parent has been in daily caregiving, each parent's willingness to support the child's relationship with the other parent, and any history of domestic violence or abuse. The child's preference is also considered when the child is mature enough to express a reasoned opinion.

Virginia courts can award joint or sole legal and physical custody in any combination that serves the child's needs. Joint legal custody is common when both parents are cooperative and capable of co-parenting. The physical custody schedule is tailored to the child's school, activities, and the distance between the parents' homes.

Section 20-124.4 requires courts to send parents to dispute resolution orientation before a custody case goes to trial. Many cases in the 9th Circuit resolve through mediation without a hearing. Relocation with a child requires 30 days' advance notice under § 20-124.5, and the other parent can seek court review.

Virginia Child Support Enforcement Services

Gloucester County residents can access child support services through Virginia's Division of Child Support Enforcement (DCSE). This agency provides free services to all parents and caretakers and can establish paternity, create support orders, and enforce payment through multiple mechanisms.

Enforcement tools include wage withholding, tax refund intercepts, suspension of driver's licenses and professional licenses, and credit bureau reporting. Administrative support orders issued under § 63.2-1903 carry the same legal weight as court orders. Interstate support matters are handled under UIFSA, codified in Chapter 5.3 of Title 20.

Family court records in Gloucester County are retained for at least 20 years under § 17.1-213. This means support orders and custody decrees from years past remain accessible. Long retention periods matter when you need to verify what a prior order said, enforce old support arrears, or document a custody modification history.
