Virginia divorce law is set out in Chapter 6 of Title 20. Under § 20-91, a no-fault divorce is available after one year of continuous separation. If both parties have no minor children and have signed a separation agreement, the waiting period is six months. Fault grounds including adultery, cruelty, willful desertion, and felony conviction remain available. Marital property is divided under § 20-107.3, which requires the court to classify, value, and fairly distribute all marital assets and debts before entering a final decree.
Spousal support follows § 20-107.1. Courts look at each party's income, earning capacity, age, health, standard of living during the marriage, and length of the marriage. The clerk maintains all public case records and grants access under § 17.1-208.

J&DR Court: Custody, Support, and Protective Orders
The Mathews County Juvenile and Domestic Relations District Court is co-located with the Circuit Court on Buckley Hall Road. This court handles child custody and visitation petitions, child support orders, paternity cases, and family abuse protective orders for Mathews County residents.
The J&DR Court operates under Chapter 11 of Title 16.1. Section 16.1-241 gives the court exclusive original jurisdiction over custody, support, and protective order matters when they arise outside of an active Circuit Court divorce case. Parents who need a custody or support order on its own file their petition here.
Child support amounts are calculated using the income shares model in § 20-108.2. The court looks at both parents' gross incomes to get a combined support figure, then assigns each parent a share based on their portion of the total. Support can extend past age 18 for children who are still enrolled full-time in high school, up to their 19th birthday.
Note: Family abuse protective orders in Mathews County are issued under § 16.1-253.2. Emergency protective orders are available through the on-duty magistrate after regular court hours.
How to Request Mathews County Family Court Records
Family court records in Mathews County are generally public and open to inspection. You can access them by going to the courthouse in person, mailing a written request, or using the Virginia Judicial System's free online case search tool.
The state's online system lets you search cases by party name or case number. It shows filing dates, hearing schedules, and case status but does not display images of actual documents. To get copies of filed materials, you need to go through the clerk's office directly.
In-person requests at the Mathews County Courthouse are handled Monday through Friday during business hours. Know the full name of at least one party and the approximate year of filing. The clerk will find the file and provide copies at rates authorized by § 17.1-275. Certified copies cost more and must be requested specifically in writing.
For mail requests, include the parties' names, the approximate filing year, your mailing address, and payment or a request for a cost estimate. The clerk has up to 30 days to respond under § 17.1-208(F), though many requests are processed well before that deadline.

Child Custody Standards in Mathews County
Custody decisions in Mathews County are governed by the best interests of the child standard under § 20-124.2 and § 20-124.3. Virginia law does not presume that either parent has an automatic advantage in a custody dispute.
Courts weigh ten factors including the child's age and physical and mental condition, each parent's age and health, the quality of the parent-child relationship for each parent, the child's ties to siblings and extended family, the role each parent has played in raising the child, each parent's willingness to support the child's ongoing relationship with the other parent, the reasonable preference of a child old enough to express one, and any history of family abuse or sexual abuse.
Under § 20-124.4, parents in disputed custody cases must complete a dispute resolution orientation before trial. Certified mediators run these sessions at no cost to the parties. Mediation resolves many custody disputes without a full hearing, which is less stressful for children and often produces arrangements that both parents follow more readily.
If a custodial parent wants to relocate with the child, § 20-124.5 requires written notice to the other parent at least 30 days before the planned move. Skipping this notice step can be treated as a material change in circumstances and may lead to a custody modification hearing.
Virginia Child Support Enforcement Services
Mathews County residents can reach Virginia's Division of Child Support Enforcement for help with establishing, modifying, or collecting child support. The Division operates statewide and provides services at no cost regardless of the applicant's income.
The Division can establish paternity through genetic testing, obtain administrative support orders under § 63.2-1903, enforce orders through income withholding, intercept tax refunds, suspend driver's licenses and professional licenses, and report non-paying parents to credit bureaus. Administrative orders carry the same legal weight as court orders. Interstate support matters follow UIFSA under Chapter 5.3 of Title 20.
Note: Civil family court records in Mathews County are kept for at least 20 years from the date of the last court order under § 17.1-213, so older case files remain accessible after cases are closed.
