Virginia's divorce statutes are in Chapter 6 of Title 20 of the Virginia Code. Under § 20-91, no-fault divorce requires parties to have lived separate and apart for one year. J&DR Court: Custody, Support, and Protective Orders
The King William County Juvenile and Domestic Relations District Court is located in the same courthouse. It handles custody and visitation petitions, child support, paternity proceedings, and family abuse protective orders. The court follows Chapter 11 of Title 16.1.
Section 16.1-241 gives the J&DR Court exclusive original jurisdiction over custody, support, and protective order matters outside of active divorce cases. A parent who needs to establish or change custody independently of a divorce must file a petition here. The court schedules a hearing, notifies both parties, and may appoint a guardian ad litem if the case is contested.
Child support follows the guidelines in § 20-108.2. Both parents' gross incomes are used to calculate the total support amount, which is then adjusted based on the custody arrangement, childcare costs, and health insurance expenses. The court can issue wage withholding orders to collect support at the source.

How to Request King William County Family Court Records

Mediation often helps families in King William County avoid a full contested hearing, which reduces cost and stress for all parties, especially children.
Relocating with a child requires 30 days written notice to the other parent under § 20-124.5. A parent who moves without notice risks a custody modification proceeding.
Virginia Child Support Enforcement Services
King William County residents can access Virginia's statewide child support enforcement program for help with establishing or collecting support. The Division of Child Support Enforcement within the Department of Social Services provides free services to any parent or caretaker regardless of income.
