Page County Circuit Court Family Records

The Page County Circuit Court sits in Luray and serves as the primary court for family law matters in the county. It holds exclusive jurisdiction over divorce proceedings, equitable distribution of marital property, and spousal support. J&DR Court: Custody, Support, and Protective Orders

The Page County Juvenile and Domestic Relations District Court is located in the same building as the Circuit Court in Luray. It handles child custody and visitation petitions, child support establishment and modification, paternity cases, juvenile matters, and family abuse protective orders under Chapter 11 of Title 16.1.

Section 16.1-241 of the Virginia Code gives the J&DR Court exclusive original jurisdiction over custody, visitation, and support cases involving children, as well as protective order petitions filed by family and household members. Parents who need to establish or change a custody arrangement outside of a divorce case file their petition in the J&DR Court.

Child support amounts are calculated using the guidelines in § 20-108.2, which base the obligation on both parents' gross incomes and the custody split. Support for children who turn 18 and remain enrolled full-time in high school continues until graduation or the child's 19th birthday, whichever comes first.

Note: Emergency protective orders in Page County can be obtained through the J&DR Court during business hours or through the on-call magistrate at any hour under § 16.1-253.4.

How to Request Page County Family Court Records

Family court records in Page County are public, with limited exceptions for sealed cases such as adoptions and some juvenile matters. You can access them in person at the courthouse, by mail, or by using Virginia's free online case search tool.

The Virginia Judicial System's online case information portal lets you search by name or case number to find basic case data including hearing dates and case status. It does not provide document images. To get copies of actual filings, you need to contact the clerk's office directly.

For in-person requests, go to the Page County Courthouse at 116 S Court St in Luray. Bring the name of at least one party and the approximate filing year. The clerk will locate the case and quote a copy fee. Under § 17.1-275, copy fees cannot exceed the actual cost of duplication. Certified copies cost more and must be requested in writing.

Mail requests should include the party name, approximate case year, and a return address. Include payment or ask the clerk to provide a fee estimate before processing. The clerk has up to 30 days to respond under § 17.1-208(F), though most requests are handled much sooner.

If you are looking for older records, the clerk's office retains civil case files for at least 20 years under § 17.1-213. Many older records are also available on microfilm or in archived paper files.

Types of Family Court Records in Page County

Child Custody Standards in Page County

Custody decisions in Page County follow the best interests of the child standard under § 20-124.2 and § 20-124.3. Virginia law does not favor either parent based on age, sex, or any other factor unrelated to the child's welfare.

Courts in the 26th Circuit must weigh ten statutory factors when deciding custody. These include the child's age and physical needs, each parent's age and health, the relationship between each parent and the child, the child's ties to siblings and extended family, the role each parent has played in raising the child, each parent's willingness to support the other parent's relationship with the child, any reasonable preference the child expresses, and any history of abuse.

Section 20-124.4 requires the court to refer parents to dispute resolution orientation before a contested custody case goes to trial. Certified mediators conduct these sessions at no cost to the parties. Many Page County families resolve custody disputes in mediation, which tends to produce more lasting agreements and reduces stress on children.

If a custodial parent plans to relocate with the child, § 20-124.5 requires at least 30 days written notice to the other parent. A move without notice can be treated as a material change in circumstances supporting a custody modification request.

Virginia Child Support Enforcement Services

Page County residents can contact Virginia's Division of Child Support Enforcement for help with support cases. The Division operates statewide and handles paternity establishment, support order creation, and enforcement services.

Services include genetic testing for paternity, administrative support orders under § 63.2-1903, income withholding, tax refund intercepts, license suspension for non-payment, and credit bureau reporting. These services are available to any parent or caretaker regardless of income level. Administrative support orders have the same legal force as court orders entered by a judge.

Note: Interstate child support matters are handled under UIFSA, which Virginia adopted under Chapter 5.3 of Title 20, ensuring support orders can be enforced across state lines.

Virginia Vital Records for Page County

Marriage and divorce records for Page County are also available from the Virginia Department of Health Vital Records office. Vital Records maintains statewide indexes and issues certified copies of marriage and divorce certificates. This is useful when you need a certified copy but cannot visit Luray in person.

Marriage licenses in Page County are issued by the Clerk of Circuit Court under § 20-14. Licenses are valid for 60 days from the issue date. After the ceremony, the officiant returns the signed license to the clerk, who files and preserves it. Certified copies are available from both the clerk and the Vital Records office and serve as legal proof of the marriage.
