Madison County Circuit Court Family Records

The Madison County Circuit Court is the court of record for all divorce proceedings, property division disputes, and spousal support matters in this part of the Shenandoah foothills region. Every document filed in a divorce case becomes part of the public record maintained by the Clerk of Circuit Court.

Divorce law in Madison County, like the rest of Virginia, is governed by Chapter 6 of Title 20. Under § 20-91, spouses seeking a no-fault divorce must live separate and apart for at least one year. That period is reduced to six months if there are no minor children and the couple has a written separation agreement. Fault grounds including adultery, cruelty, willful desertion, and felony conviction are also recognized. Marital property division follows § 20-107.3, which requires classification of all assets and debts before distribution.

Spousal support is determined under § 20-107.1. The court reviews each party's income, needs, earning capacity, length of the marriage, standard of living, and health. The clerk retains all case records and provides public access to non-restricted documents under § 17.1-208.

J&DR Court: Custody, Support, and Protective Orders

The Madison County Juvenile and Domestic Relations District Court is housed in the same building at 1 Main St. This court handles child custody and visitation cases, child support establishment and modification, paternity determinations, juvenile matters, and family abuse protective orders.

The J&DR Court draws its authority from Chapter 11 of Title 16.1. Section 16.1-241 gives the court exclusive original jurisdiction over custody and support cases not connected to an active divorce proceeding. Parents who need a custody or support order outside of a divorce case file their petition directly in the J&DR Court.

Child support calculations in Madison County follow the income shares guidelines in § 20-108.2. The court combines both parents' gross incomes to get a total support obligation, then assigns each parent a share based on their income percentage. Support for children 18 and older who are still enrolled full-time in high school continues until they graduate or turn 19.

Note: Family abuse protective orders in Madison County are issued under § 16.1-253.2. Emergency orders are available through the on-duty magistrate outside of regular court hours.

How to Request Madison County Family Court Records

Most family court records in Madison County are public. You can access them in person at the courthouse, by mailing a written request, or by using the Virginia Judicial System's free online case search.

The state's online case information tool lets you search by party name or case number and view basic filing details, hearing dates, and case status for both Circuit Court and J&DR cases. It does not show images of filed documents. To get actual copies, contact the clerk's office at the Madison County Courthouse on Main Street.

In-person requests are handled during business hours. Bring the full name of at least one party and the approximate filing year. The clerk can locate the case and provide copies at the rates set by § 17.1-275. Certified copies require a specific written request and carry a higher fee than plain paper copies.

Mail requests should include party names, the approximate year the case was filed, your mailing address, and payment or a request for a fee estimate. Under § 17.1-208(F), the clerk has up to 30 days to respond, though many requests are filled more quickly than that.

Types of Family Court Records in Madison County

Circuit Court divorce files in Madison County contain the original complaint, any counterclaim, financial disclosure statements, property settlement agreements, custody orders if applicable, and the final decree. Contested cases may also include testimony transcripts and exhibits. J&DR files cover custody and visitation orders, child support worksheets and orders, income withholding notices, protective orders, and paternity determinations.

Certain records are not publicly available. Adoption case files, juvenile delinquency records, and some child abuse proceedings are sealed. Access to sealed records requires filing a motion and showing good cause. The judge reviews the request and decides whether to grant access based on the specific situation.

Child Custody Standards in Madison County

Madison County courts decide custody based on the best interests of the child standard in § 20-124.2 and § 20-124.3. Virginia does not presume that one parent is automatically better suited for custody. The child's welfare drives every custody decision.

Judges weigh ten statutory factors including the child's age and physical and mental condition, each parent's age and health, the nature of the relationship between each parent and the child, the child's ties to siblings and extended family, each parent's involvement in the child's day-to-day life, each parent's willingness to support the child's relationship with the other parent, the child's own preference if the child is old enough to have a reasonable view, and any history of abuse.

Section 20-124.4 requires parents in contested custody disputes to attend a dispute resolution orientation before the matter goes to trial. A certified mediator runs these sessions. Mediation often helps parents reach agreements on their own, which is less disruptive for children and tends to produce arrangements that last longer than court-imposed orders.

Relocation requires notice. Under § 20-124.5, a custodial parent who plans to move must give the other parent written notice at least 30 days before the move. Failing to do so can be considered a material change in circumstances and may prompt the court to revisit custody.

Virginia Child Support Enforcement Services

Madison County residents can get help with child support through Virginia's Division of Child Support Enforcement, part of the Department of Social Services. Services are available regardless of income and cover establishment, modification, and enforcement of support orders.

The Division can establish paternity through genetic testing, secure administrative support orders under § 63.2-1903, enforce orders via income withholding, intercept tax refunds, suspend licenses, and report delinquent parents to credit agencies. Administrative orders have the same legal force as court orders. Interstate cases follow UIFSA, codified in Chapter 5.3 of Title 20.

Note: Civil family court records in Madison County are retained for at least 20 years from the date of the last order under § 17.1-213, so old divorce and custody files remain accessible well after a case ends.

Virginia Vital Records for Madison County

Marriage and divorce certificates for Madison County are also on file with the Virginia Department of Health Vital Records office. Vital Records maintains a statewide index and issues certified copies for legal purposes. This is a convenient option when you cannot go to the Madison County Courthouse in person.

Marriage licenses are issued by the Clerk of Circuit Court under § 20-14 and are valid for 60 days. After the ceremony, the officiant sends the signed license back to the clerk for permanent filing. Certified copies of marriage licenses are available from both the Circuit Court clerk's office and the Vital Records office.
