Orange County Circuit Court Family Records

The Orange County Circuit Court handles all divorce proceedings, property division, and spousal support matters for the county. When a divorce is filed in Orange County, every document in the case becomes part of the permanent public record kept by the Clerk of Circuit Court at 110 N Madison Rd.

Divorce in Virginia is governed by Chapter 6 of Title 20. Under § 20-91, a no-fault divorce requires living separate and apart for one year. Spouses with no minor children and a written separation agreement can petition after six months. Fault grounds including adultery, cruelty, willful desertion, and felony conviction are available under the same statute. Equitable distribution of marital property follows § 20-107.3, which directs the court to classify all assets and debts before assigning values and dividing them fairly.

Spousal support is determined under § 20-107.1. The court considers each party's income and earning capacity, financial needs, the standard of living during the marriage, how long the marriage lasted, and each party's age and health. The clerk makes case records available to the public under § 17.1-208.

J&DR Court: Custody, Support, and Protective Orders

The Orange County Juvenile and Domestic Relations District Court is co-located with the Circuit Court at 110 N Madison Rd. This court handles child custody and visitation petitions, child support cases, paternity determinations, juvenile matters, and family abuse protective orders for Orange County families.

The J&DR Court operates under Chapter 11 of Title 16.1. Section 16.1-241 grants the court exclusive original jurisdiction over custody, support, and protective order matters not connected to an active Circuit Court divorce case. Parents who need a standalone custody or support order file their petition in the J&DR Court.

Child support amounts are calculated using the income shares guidelines in § 20-108.2. The court combines both parents' gross incomes to determine the total support obligation, and each parent pays a proportional share. Support can extend past age 18 for children enrolled full-time in high school, up to their 19th birthday.

Note: Family abuse protective orders in Orange County are issued under § 16.1-253.2. Emergency orders are available through the on-duty magistrate outside of regular court hours.

How to Request Orange County Family Court Records

Most family court records in Orange County are public. You can access them in person at the courthouse, by mail, or through the Virginia Judicial System's free online case search tool.

The state's online tool lets you search cases by party name or case number and view basic case information including filing dates, hearing dates, and case status. It does not display images of actual documents. To get copies of filed materials, contact the clerk's office at 110 N Madison Rd directly.

In-person requests are handled during regular business hours Monday through Friday. Have the full name of at least one party and the approximate filing year ready. The clerk locates the file and provides copies at fees set by § 17.1-275. Certified copies require a specific written request and cost more than plain copies.

For mail requests, include party names, the approximate filing year, your mailing address, and payment or a request for a fee estimate. The clerk has up to 30 days to respond under § 17.1-208(F), though most requests are filled faster than that deadline.

Types of Family Court Records in Orange County

Circuit Court divorce files in Orange County typically include the complaint for divorce, any counterclaim, financial disclosure statements, property settlement agreements, and the final decree. Contested cases may also include deposition transcripts and exhibits. J&DR files contain custody and visitation orders, child support worksheets and orders, income withholding notices, protective orders, and paternity determinations.

Some records are restricted. Adoption files, juvenile delinquency records, and certain child abuse and neglect proceedings are sealed. Access to restricted records requires a court motion and a showing of good cause. The judge reviews the request and decides whether to allow access.

Child Custody Standards in Orange County

Orange County courts decide custody based on the best interests of the child standard in § 20-124.2 and § 20-124.3. Virginia law does not favor either parent based on gender or any other characteristic unrelated to the child's welfare.

Courts weigh ten statutory factors: the child's age and physical and mental condition, each parent's age and health, the quality of each parent's relationship with the child, the child's ties to siblings and extended family, the historical role each parent has played in raising the child, each parent's willingness to foster the child's relationship with the other parent, the reasonable preference of a child mature enough to have a considered view, and any history of family abuse or sexual abuse.

Section 20-124.4 requires parents in contested custody disputes to attend a dispute resolution orientation before trial. Certified mediators run these sessions at no cost to the parties. Mediation often produces agreements without a full contested hearing, which is less hard on children and tends to result in more durable custody arrangements.

Relocation notice is required. Under § 20-124.5, a custodial parent who plans to move with the child must give the other parent written notice at least 30 days before the move. Failing to provide this notice can be treated as a material change in circumstances and may lead to a custody modification proceeding.

Virginia Child Support Enforcement Services

Orange County residents can get help with child support through Virginia's Division of Child Support Enforcement, part of the Department of Social Services. The Division provides services statewide at no cost regardless of the applicant's income.

The Division can establish paternity through genetic testing, obtain administrative support orders under § 63.2-1903, enforce orders through income withholding, intercept tax refunds, suspend driver's and professional licenses, and report delinquent parents to credit agencies. Administrative orders have the same legal force as court orders. Interstate support cases involving Orange County residents follow UIFSA under Chapter 5.3 of Title 20.

Note: Civil family court records in Orange County are kept for at least 20 years from the date of the last court order under § 17.1-213, so older divorce and custody files remain accessible after cases end.

Virginia Vital Records for Orange County

Marriage and divorce records for Orange County are also available from the Virginia Department of Health Vital Records office. Vital Records keeps a statewide index and can issue certified copies. This is a useful option when traveling to Orange is not practical.

Marriage licenses are issued by the Clerk of Circuit Court under § 20-14 and are valid for 60 days. After the ceremony, the officiant sends the signed license back to the clerk for permanent filing. Certified copies are available from both the Circuit Court clerk and the Vital Records office.
