J&DR Court: Custody, Support, and Protective Orders

The Spotsylvania County Juvenile and Domestic Relations District Court is also located at 9104 Courthouse Rd and can be reached at (540) 507-7680. Under Chapter 11 of Title 16.1, the J&DR Court has exclusive original jurisdiction over child custody, visitation, child support, paternity, juvenile delinquency, and protective orders for family abuse.

Section 16.1-241 defines when the J&DR Court must be used. Any custody or support matter that arises outside of an active Circuit Court divorce case must be filed in the J&DR Court. Child support is set using the statutory guidelines at § 20-108.2, which base the support amount on both parents' gross incomes and the custody arrangement. The court may deviate from the guideline amount in unusual circumstances. Support obligations can extend past age 18 when a child is still enrolled full-time in high school, up to age 19.

Protective orders for family abuse are available under § 16.1-253.2. Emergency orders can be issued by a magistrate when the court is not open. A preliminary protective order lasts up to 15 days, and a final protective order can last up to two years. Violation of any protective order is a criminal offense and can lead to immediate arrest under § 16.1-253.2(F).
