J&DR Court: Custody, Support, and Protective Orders

The King George County Juvenile and Domestic Relations District Court is in the same courthouse building as the Circuit Court. It handles custody and visitation cases, child support petitions, paternity proceedings, and family abuse protective orders under Chapter 11 of Title 16.1.

Under § 16.1-241, this court has exclusive original jurisdiction over custody, support, and protective order matters that are not part of an active Circuit Court divorce case. To establish custody outside of a divorce, a parent must file a petition with the J&DR Court clerk. Hearings are scheduled and both parties are notified. Contested custody cases may result in a guardian ad litem being appointed for the child.

Child support in King George County follows the income shares guidelines in § 20-108.2. Both parents' gross incomes are combined, and support is set based on that amount and the custody arrangement. Childcare expenses and health insurance costs can be factored in as well. The court can issue wage withholding orders to collect support directly from an employer.

How to Request King George County Family Court Records

Most family court records in King George County are public and open to inspection. You can access them in person, by mail, or through the state's free online case search tool.

The Virginia Judicial System's online case information system is available at no cost. You can search by party name or case number and see case status, filing dates, and hearing information for King George County cases. It does not show document images. For copies of actual filings, you need to contact the clerk's office.

For in-person requests, visit the courthouse during business hours. Bring the full name of at least one party and the approximate year of filing. The court may weigh additional factors not in the statute as well.

Under § 20-124.4, parents in contested custody cases must attend a dispute resolution orientation before trial. These sessions are free and run by certified mediators. Many King George County families reach custody agreements this way without going to a full contested hearing, which saves time and money for everyone involved.

If a parent plans to relocate with the child, § 20-124.5 requires 30 days written notice to the other parent. Failing to give this notice can result in a modification of the custody order.

Virginia Child Support Enforcement Services

King George County residents can get help with child support through Virginia's statewide enforcement program. The Division of Child Support Enforcement within the Department of Social Services offers free services to any parent or caretaker, regardless of income.

The Division can establish paternity through genetic testing, set up administrative support orders under § 63.2-1903, enforce orders through income withholding, intercept tax refunds, suspend licenses, and report delinquent parents to credit bureaus. Administrative orders are legally equivalent to court orders. King George County residents can access DCSE through the statewide program.
