Divorce proceedings in Greene County follow Chapter 6 of Title 20. Under § 20-91, a no-fault divorce requires one year of living separate and apart. Adultery, cruelty, desertion, and felony conviction remain valid fault grounds under the same statute.
Marital property is divided under § 20-107.3 through equitable distribution. The court classifies property as separate or marital, assigns values, and distributes the marital estate based on contributions, the length of the marriage, and each party's financial circumstances. Spousal support is set under § 20-107.1. All filed documents are public records under § 17.1-208 unless sealed by court order.

J&DR Court: Custody, Support, and Protective Orders
The Greene County Juvenile and Domestic Relations District Court is in the same building at 22 Court St. This court handles child custody and visitation petitions, child support orders, paternity proceedings, and protective order requests. It also has jurisdiction over juvenile delinquency and child protective services cases.
Custody and visitation cases are decided under the best interests standard in § 20-124.2 and the ten-factor analysis in § 20-124.3. The court looks at the child's age, physical and emotional needs, each parent's mental and physical health, each parent's involvement in day-to-day caregiving, and any history of family abuse. Virginia does not presume either parent is better suited for custody.
Child support is calculated under the income shares guidelines in § 20-108.2. The formula combines both parents' gross incomes, accounts for work-related childcare costs and health insurance, and splits the obligation proportionally. The court can deviate from the formula when the standard result would be unjust given the particular circumstances.
Note: Family abuse protective orders in Greene County are issued under § 16.1-253.2. Emergency orders are available around the clock through the on-duty magistrate.

For mail requests, write to the clerk with the case name, party names, filing year, and payment or a request for a cost estimate. Under § 17.1-208, the clerk must respond within 30 days. Most routine requests are processed faster.

Child Custody Standards in Greene County
Greene County courts decide custody and visitation using the best interests of the child standard. Virginia law does not presume that either parent should have primary custody. The court looks at the specific circumstances of each family using the factors in § 20-124.3.
The factors judges weigh include the child's age and physical condition, each parent's mental and physical health, the existing relationship between the child and each parent, each parent's involvement in daily caregiving, each parent's ability to support the child's relationship with the other parent, and any history of abuse or neglect. When a child is old enough to form and express a preference, the court considers it, but is not bound to follow it.
Courts in the 16th Circuit refer parents to dispute resolution orientation before setting a custody trial date under § 20-124.4. Mediation has helped many Greene County families reach parenting agreements without a contested hearing. When parents agree on a plan, the court reviews it to confirm it serves the child's best interests before entering an order.
Under § 20-124.5, a parent who plans to move with a child must give 30 days' written notice to the other parent. If the other parent objects, the court will determine whether the move is appropriate.
