Bath County Overview
Bath County Circuit Court Family Records
The Bath County Circuit Court is part of the 25th Judicial Circuit. The courthouse is on Courthouse Square in Warm Springs. The Clerk of Circuit Court maintains all divorce files, property division records, and spousal support orders for Bath County residents.
Virginia divorce law is found in Chapter 6 of Title 20. Under § 20-91, a no-fault divorce requires one full year of separation without cohabitation. If the parties have no minor children and have entered a written property settlement agreement, that period is six months. Fault grounds are also available, including adultery, cruelty, willful desertion, and felony conviction with imprisonment.
The court divides marital property under § 20-107.3 by classifying all assets and debts, assigning values, and making an equitable distribution. Factors include the length of the marriage, each spouse's contributions, and the economic circumstances of each party. Spousal support follows § 20-107.1 and depends on each party's financial condition, the length of the marriage, each spouse's earning capacity, and what standard of living existed during the marriage.

J&DR Court: Custody, Support, and Protective Orders
The Bath County Juvenile and Domestic Relations District Court sits in the same building. Under Chapter 11 of Title 16.1, the J&DR Court has exclusive original jurisdiction over child custody and visitation, support, paternity, and protective order matters in Bath County.
Section 16.1-241 sets out what the J&DR Court handles. Parents who want to establish or modify custody file petitions here unless the matter is already part of a pending divorce in the Circuit Court. J&DR Court orders carry the same legal force as any court order and can be enforced through contempt proceedings. Either party may appeal a J&DR ruling to the Circuit Court for a de novo hearing.
Child support is calculated using the income shares guidelines in § 20-108.2. Both parents' gross incomes go into the formula along with the custody split, health insurance costs, and work-related childcare expenses. The formula produces a base support amount that the court can adjust in unusual circumstances.
Note: Family abuse protective orders in Bath County are issued under § 16.1-253.2. Emergency protective orders are available through the on-duty magistrate at any time of day or night.
How to Request Bath County Family Court Records
Family court records in Bath County are public. You can request them in person at the courthouse, by mail, or by searching the state's online case system. Bath County is a small, rural county, so planning ahead before your visit is a good idea.
The Virginia Judicial System's free case search tool is at eapps.courts.state.va.us. This tool covers Circuit Court and J&DR cases statewide. You can search by name or case number and see case status, hearing dates, and basic details. Document images are not available online. To get copies of actual filings, contact the clerk directly.
In-person requests at the Bath County Courthouse in Warm Springs are handled during regular business hours. Bring the full name of at least one party and the approximate year the case was filed. The clerk can locate the record and provide copies at the rates allowed by § 17.1-275. Certified copies require a specific written request.
For mail requests, send the party names, case number if known, filing year, your address, and either payment or a request for a cost estimate. The clerk has up to 30 days to respond under § 17.1-208(F). Given the small size of the office, calling ahead to confirm the right process is advisable.
Types of Family Court Records in Bath County
Bath County courts hold various types of family law records. Circuit Court divorce files typically include the complaint, financial disclosure statements, any property settlement agreement, and the final decree. Contested cases may also include motions, exhibits, and hearing notes or transcripts.
- Divorce decrees and final orders
- Property settlement agreements
- Custody and visitation orders
- Child support orders and income withholding orders
- Protective orders under § 16.1-253.2
- Paternity orders and acknowledgments
- Spousal support orders

Adoption files, juvenile delinquency records, and child abuse or neglect proceedings are sealed under Virginia law. You must file a motion and show good cause to access those records. The judge decides whether the facts justify access.
Child Custody Standards in Bath County
Bath County courts apply the best interests of the child standard under § 20-124.2 and § 20-124.3. Virginia law does not presume that either parent is better suited for custody. The court looks at the full picture of each family's situation.
Statutory factors include the child's age and physical condition, the mental and physical health of each parent, the quality of each parent's relationship with the child, the child's bonds with siblings and extended family, each parent's level of involvement in daily caregiving, each parent's willingness to support the other's bond with the child, any preference the child can express if old enough, and any history of family abuse or neglect. No single factor is decisive.
Under § 20-124.4, courts must refer parents to a dispute resolution orientation before contested custody cases go to trial. These sessions are run by certified mediators and are low cost or free. Many families reach agreement through mediation, which tends to produce more lasting custody plans and is less difficult on the children.
A parent who plans to move with a child must give the other parent at least 30 days of written notice under § 20-124.5. Failing to give that notice can be used as grounds to seek a custody modification.
Virginia Child Support Enforcement Services
Bath County residents can use Virginia's child support enforcement program for help with support. The Division of Child Support Enforcement (DCSE) within the Department of Social Services operates statewide and is open to any parent or caretaker regardless of income.
DCSE can establish paternity through genetic testing, enter administrative support orders under § 63.2-1903, enforce orders through income withholding, intercept tax refunds, suspend driver's licenses for non-payment, and report delinquent parents to credit bureaus. Administrative orders have the same force as court orders. Contact the Bath County Department of Social Services in Warm Springs to apply for DCSE services.
Note: Interstate child support cases are handled under the Uniform Interstate Family Support Act at Chapter 5.3 of Title 20.
Civil case files in Bath County are kept for at least 20 years from the date of the last order under § 17.1-213. Older divorce and custody records remain accessible long after the case closes, which is important when you need to verify old support orders or check past custody arrangements.
