Rockbridge County Circuit Court Family Records

The Rockbridge County Circuit Court is located at 2 S Main St in Lexington. It is the primary court for divorce, property division, and spousal support cases in the county. Note that the independent cities of Lexington and Buena Vista are located within the county's borders but maintain their own separate courts; county residents use the Rockbridge County courthouse on South Main Street. Under § 20-91, a no-fault divorce requires one year of separation, or six months when there are no minor children and a signed separation agreement exists. J&DR Court: Custody, Support, and Protective Orders

The Rockbridge County Juvenile and Domestic Relations District Court is in the same building as the Circuit Court on South Main Street in Lexington. It handles custody and visitation petitions, child support cases, paternity determinations, juvenile matters, and family abuse protective orders under Chapter 11 of Title 16.1.

Under § 16.1-241, the J&DR Court holds exclusive original jurisdiction over custody, support, and protective order matters involving children and family members. Parents who need to set or change a custody or support arrangement outside of a pending divorce case must file a petition here. Protective orders against family abuse are also issued here or through the after-hours magistrate.

Child support is calculated under the guidelines in § 20-108.2. The formula uses both parents' gross incomes, the custody time split, health insurance costs, and work-related childcare expenses. Support can continue past age 18 for children still enrolled full-time in high school, up to age 19.

Note: Emergency protective orders in Rockbridge County are available at any time through the on-call magistrate under § 16.1-253.4. County residents should file at the Rockbridge courthouse; city residents of Lexington or Buena Vista use their own city courts.

How to Request Rockbridge County Family Court Records

Family court records in Rockbridge County are public records open to inspection, with limited exceptions for sealed cases. You can access them in person at the Lexington courthouse, by mail, or through Virginia's free online case information portal.

The Virginia Judicial System's free online tool lets you search statewide by name or case number. It returns basic case information including filing dates, case status, and upcoming hearings. It does not provide document images. To get actual copies of filings, you must contact the clerk.

In-person requests at 2 S Main St in Lexington are handled during business hours. Bring the full name of at least one party and the approximate year of filing. The clerk will locate the case and quote a copy fee under § 17.1-275. Fees are capped at actual duplication costs. Certified copies require a written request.

Mail requests should include party names, the case year, your contact information, and a payment or fee estimate request. The clerk has up to 30 days to respond under § 17.1-208(F). Records are retained for at least 20 years under § 17.1-213.

Child Custody Standards in Rockbridge County

Custody cases in Rockbridge County follow the best interests of the child standard in § 20-124.2 and § 20-124.3. Virginia courts do not favor either parent based on sex, age, or any factor unrelated to the child's welfare.

The ten statutory factors courts consider include the child's age and physical needs, each parent's age and health, the parent-child relationship, the child's bonds with siblings and extended family, the role each parent has played in daily caregiving, each parent's willingness to support the other parent's relationship with the child, any preference the child expresses if old enough, and any history of family violence or abuse.

Section 20-124.4 requires parents to attend a free dispute resolution orientation before a contested custody case goes to trial. Certified mediators run these sessions. Many families in the 25th Circuit resolve custody disputes through mediation, which tends to produce more durable arrangements than contested hearings.

If a parent plans to move with the child, § 20-124.5 requires 30 days written notice to the other parent. Moving without notice can support a custody modification request.

Virginia Child Support Enforcement Services

Rockbridge County residents can use the Virginia Division of Child Support Enforcement for help with support cases. Services include paternity establishment, administrative support orders under § 63.2-1903, income withholding, tax refund intercepts, license suspension, and credit bureau reporting.

These services are available to all parents and caretakers regardless of income. Interstate cases are handled under UIFSA, adopted under Chapter 5.3 of Title 20. Administrative support orders carry the same legal force as court-entered orders.
